§ 2. General provisions
1. The Customer shall use the Store in accordance with law, these Terms and Conditions, good practice, and with respect for the rights of the Seller and third parties.
2. A natural person placing an Order should be of legal age and have full legal capacity. A person acting for a legal person or other entity declares that they are authorised to represent it.
3. It is prohibited to provide unlawful content or malware, attempt unauthorised access to Store systems, or take action disrupting their operation.
4. Product information in the Store constitutes an invitation to enter into a contract unless expressly stated otherwise.
5. The Seller may conduct promotions and provide discount codes. Their terms may be set out separately. When announcing a price reduction, the Seller states, next to the promotional price, the lowest price applied during the 30 days before the reduction, or, where the Product has been offered for less than 30 days, the lowest price applied since it was first offered.
6. The Store is generally available 24 hours a day. The Seller may temporarily restrict access for technical, security, maintenance or development reasons, while seeking to limit inconvenience to Customers.
7. The Seller enables Orders from Poland and other countries, subject to delivery availability in the relevant country, carrier restrictions, local legislation and the possibility of customs clearance.
§ 3. Electronic Services
1. The Seller provides free Electronic Services:
- access to Store content and Product information;
- use of the basket and Order Form;
- creation and maintenance of a Customer Account;
- use of the contact form;
- and the Newsletter after the required consent has been obtained.
2. The contract for use of the Order Form is concluded for the time the form is used and ends when the Order is submitted or use of the form is discontinued.
3. The Customer Account contract is concluded for an indefinite period. Creating an Account is voluntary, free and not required to place an Order. The Customer may resign at any time by requesting deletion at contact@happy-mouse.pl or using the relevant Account function, if available. Deletion of an Account does not remove data which must continue to be stored by law or is necessary to establish, pursue or defend claims.
4. The Newsletter contract is concluded for an indefinite period upon successful subscription and may be terminated at any time by the unsubscribe link or a message to the Seller.
5. Use of the Store requires an internet-enabled device, an up-to-date web browser, support for necessary cookies and, for Orders and an Account, an active e-mail address.
6. The Customer bears internet connection and data-transmission costs under their agreement with their service provider.
§ 4. Products, variants and safety information
1. The Seller offers Ready-to-ship Products, Standard Products made after an Order, Personalised Products and Individual Orders.
2. Standard Product variants are options available directly on the Product page or in the configurator, including in particular L or XL size, façade colour, detail colour, stairs, lift, ladders and standard furnishing or interior-detail sets.
3. Selecting a standard variant does not by itself mean that the Product has been made to the Customer’s individual specification.
4. Individual personalisation may include, in particular, a nameplate or other inscription, engraving, a colour outside the standard palette, altered dimensions or room layout, an additional floor unavailable in the standard configurator, altered windows, doors or construction, or production to the Customer’s individual design.
5. Information concerning dimensions, materials, variants, kit contents, intended use, assembly and safe use is provided on the Product page, packaging, markings or enclosed instructions.
6. Unless a specific Product description states otherwise, the kit includes dollhouse components, screws or other assembly components and instructions. Dolls, furniture, decorations and photographic styling items are not included unless expressly listed as part of the kit.
7. Products are handmade and hand-finished using materials with natural characteristics. Individual items may differ slightly in shade, grain, the placement of natural plywood features or the finish of hand-painted elements. Differences that do not affect conformity with the contract, safety or normal use do not constitute non-conformity.
8. Products intended for play are suitable for children aged 3 and over unless the description or marking of a specific Product states otherwise. Assembly must be performed by an adult in accordance with the instructions. A screwdriver is required for standard dollhouse assembly. Before giving the Product to a child, an adult should check completeness, correct assembly and the tightness of all components. The Product should be used as intended and under adult supervision.
9. A Product offered for distance sale contains the information required to identify it, manufacturer details, postal and electronic address, and appropriate warnings and safety information. Such information may also be placed on the Product, packaging or enclosed documentation.
§ 5. Placing Orders and concluding the Sales Contract
1. Orders may be placed through the Store 24 hours a day, 7 days a week, subject to technical interruptions.
2. An Order may be placed without registration or after logging into a Customer Account.
3. To place an Order, the Customer in particular:
- selects the Product and available variants;
- adds it to the basket;
- checks basket contents;
- provides data necessary to perform the contract;
- selects available delivery and payment methods;
- reviews the Order summary and accepts these Terms and Conditions;
- then submits the Order using the “Buy and pay” button or equivalent wording clearly indicating the obligation to pay;
4. Before submitting an Order, the Customer may identify and correct errors, in particular by returning to earlier stages or changing the basket or form data.
5. After the Order is submitted, the Seller promptly sends confirmation of acceptance for fulfilment to the e-mail address provided. The Sales Contract is concluded when the Customer receives this confirmation.
6. After conclusion, the Seller sends confirmation of the Sales Contract on a Durable Medium to the e-mail address stated in the Order Form. It includes legally required information, in particular the Order number and date, ordered Products and variants, PLN price, delivery cost and method, payment method, expected lead time, Seller details, and information on withdrawal, returns and complaints. The Terms accepted when placing the Order and the model withdrawal form are provided in the e-mail or an attachment that can be saved and reproduced unchanged. The confirmation states the date or version number of the Terms accepted by the Customer.
7. The Seller keeps information about the version of the Terms accepted by the Customer in connection with the relevant Order.
8. The Contract is concluded in Polish. It may be concluded in another language only after the full purchase process and required documents have been made available in that language.
9. If, after conclusion, an objective and permanent impossibility of fulfilling the Order becomes apparent, in particular because a configuration cannot be made, a necessary material is permanently unavailable, shipment to the Customer’s country is legally or technically prohibited, or a material system error prevents proper performance, the Seller promptly informs the Customer and may propose an alternative. If it is not accepted or is unavailable, the Contract is terminated and all received payment is refunded using the same method, unless the Customer expressly agrees to another cost-free method.
10. Temporary material unavailability, equipment failure or an increased number of Orders does not constitute permanent impossibility and is dealt with under the provisions on delayed fulfilment.
§ 6. Prices, currency and sales documents
1. Store prices are in PLN and are final prices as regards amounts charged by the Seller. The Seller benefits from the VAT exemption under Article 113(1) of the Polish VAT Act.
2. The price in PLN shown in the Order summary immediately before submission is binding on the Customer.
3. Delivery costs and all other charges collected by the Seller are stated before the Order is submitted. Delivery outside Poland is calculated under § 9.
4. For delivery outside the European Union, Product price and delivery cost exclude duty, import tax, customs charges, carrier or customs-agent handling fees and other charges collected in the recipient’s country. The recipient bears these charges under the law of the delivery country.
5. The Seller issues an invoice at the Customer’s request, made during ordering by selecting the relevant box or later within the period provided by applicable law. An invoice for an entrepreneur is issued after correct company details, including Tax ID or other required tax number, are provided.
6. An invoice and corrective invoice may be sent electronically to the e-mail address stated by the Customer. Requesting an invoice through the Store and providing an e-mail address constitutes acceptance of that delivery method. Another permitted method may be agreed.
7. Where applicable law requires an invoice to be issued or made available through the National e-Invoice System, the Seller fulfils that obligation as required. An invoice issued to a Consumer is delivered by the agreed method, in particular electronically to the provided e-mail address.
8. The Customer is responsible for the accuracy of invoice details and should notify the Seller immediately after discovering a need for correction.
§ 7. Payment methods
1. Available payment methods are presented in the Order Form and may depend on country, Order value, Product type, limits and decisions of the operator, and the Seller’s active services.
2. Methods may include:
- BLIK;
- Paynow instant online transfers;
- standard bank transfer;
- Visa and Mastercard cards;
- digital wallets made available by the operator, in particular Apple Pay or Google Pay;
- Click to Pay;
- and PayPo deferred payment.
3. Electronic payments are handled by providers identified during payment. Details of each operator are displayed in the Store and on the payment page.
Podmiotem świadczącym obsługę płatności online w zakresie płatności kartami jest Autopay S.A.
4. Store payments are settled in PLN. Not every method must be available for every Order; availability depends in particular on the payment operator’s terms.
5. For instant payments, the Customer initiates payment while placing the Order. The Seller begins fulfilment after confirmation of proper transaction authorisation and, for a made-to-order Product, confirmation of all configuration details.
6. For a standard bank transfer, payment should be made within 3 Business Days after conclusion of the Sales Contract. After that period without payment, the Seller may cancel the Order after informing the Customer.
7. If payment fails, the Customer may retry, use an available payment link, or contact the Seller.
- jest osobą pełnoletnią;
- jest konsumentem w rozumieniu art. 5 pkt 1 ustawy o kredycie konsumenckim;
- posiada numer PESEL i miejsce zamieszkania na terytorium Rzeczypospolitej Polskiej;
- posiada zdolność do spłaty zobowiązań wobec PayPo;
- uzyskał pozytywną ocenę zdolności kredytowej przeprowadzoną przez PayPo.
9. Refunds are generally made to the same payment instrument used for the original transaction unless the Customer expressly agrees to another cost-free method. Refunds for PayPo Orders are made through Paynow in accordance with the operator’s rules.
§ 8. Commencement and lead time
1. The Seller starts fulfilment:
- for electronic payment, after confirmation of proper payment authorisation and, where required, configuration;
- for bank transfer, after receipt of the full amount and, where required, configuration;
- for an Individual Order, after the Customer accepts the arrangements and fulfils agreed payment conditions, in particular after the deposit is received.
2. Expected preparation time for dispatch is:
- 1–3 Business Days for Ready-to-ship Products;
- around 2 weeks for Standard Products made to order;
- and up to around 3 weeks for the largest, more complex or non-standard orders, unless another period was agreed before conclusion.
3. Lead time for a made-to-order Product runs only once all conditions in paragraph 1 have been met, including payment or deposit and confirmation of configuration details necessary to start work.
4. Lead time means the time needed to prepare the Product for handover to the carrier and excludes transport time.
5. An Order containing Products with different availability dates is generally dispatched once complete, unless the parties agree partial shipment.
6. If the Seller expects not to meet the agreed lead time, the Seller promptly informs the Customer of the reason and proposed new date. The Customer may accept it or cancel the Order and receive a full refund.
7. The Customer shall cooperate on an Individual Order, in particular by providing information and approvals on time. Customer delay extends the completion date accordingly; the Seller will inform the Customer how missing information or approval affects the lead time.
§ 9. Delivery
1. Delivery within Poland is free for all Products, including Ready-to-ship Products, Standard Products, Personalised Products, Individual Orders, oversized and pallet shipments.
2. Delivery outside Poland is calculated automatically based on the delivery country or region and Order data, including Product type, dimensions, weight and shipping class.
3. Delivery cost and the total payable amount are shown in the basket or Order Form before the “Buy and pay” button is used. The delivery price in the Order summary is binding for the Sales Contract.
4. If the system cannot retrieve a delivery rate for the given address for technical reasons, the Order Form will not enable conclusion until delivery cost is correctly determined.
5. Delivery is made by a carrier selected by the Seller or indicated in the Order Form.
6. Expected transit time is shown on the “Delivery and payments” page, in the Order Form or Order confirmation. It runs from handover to the carrier and excludes production time.
7. Transit times are estimates. Pallet shipment, delivery to a remote region, customs clearance, border control, force majeure or carrier delay may affect delivery date.
8. For delivery outside the European Union, price and transport cost exclude duty, import tax, customs charges, carrier handling charges and other amounts collected by authorities or entities in the recipient’s country. The recipient bears them under the law of that country.
9. On receipt, it is recommended to inspect the shipment. In case of visible damage, it is advisable to prepare a damage report, take photographs of packaging, label and damage, and retain packaging until the matter is clarified.
10. Absence of a report, photographs or original packaging does not deprive a Consumer or Entrepreneur with Consumer rights of the right to complain.
11. For a Consumer, the risk of accidental loss of or damage to the Product passes to the Customer when it is handed over to the Customer or a third party designated by them other than the carrier, unless the Customer independently chose a carrier not offered by the Seller.
§ 10. Contractual cancellation before dispatch
1. Independently of the statutory withdrawal right, the Customer may cancel an Order for a Standard Product until it is handed over to the carrier by sending an unambiguous statement to: contact@happy-mouse.pl.
2. On effective cancellation, the Seller refunds all received payments, even if work on the Standard Product has begun, without undue delay and no later than 14 days after receipt of the cancellation statement.
3. This section does not apply to a Personalised Product or Individual Order, whose cancellation and settlement are governed by § 12.
4. After handover to the carrier, a Consumer may use the statutory withdrawal right under § 11 where entitled to it.
§ 11. Right of withdrawal from the Sales Contract
1. A Consumer and Entrepreneur with Consumer rights may withdraw from a distance contract within 14 days without giving a reason, subject to statutory and these Terms’ exceptions.
2. The period runs from the day the Customer or a designated third party other than the carrier takes possession of the Product. For multiple items delivered separately, in lots or parts, it runs from possession of the last item, lot or part.
3. To exercise withdrawal, the Customer must send the Seller an unambiguous statement before expiry, by post to the Seller’s address or by e-mail to: contact@happy-mouse.plThe form in Appendix 1 may be used but is not mandatory.
4. The Seller promptly confirms receipt of a statement sent electronically.
5. The Customer should return the Product without undue delay and no later than 14 days after withdrawal to HM Krzysztof Kamiński, ul. Zdrowa 6 lok. U1, 02-747 Warsaw, Poland, unless the Seller agrees to collect it.
6. The Customer bears direct return costs. Estimated costs are PLN 50–150 for small and medium Products and PLN 350–500 for Products requiring pallet transport. International return costs may be higher and depend on country, dimensions, weight and carrier; where the Product cannot normally be returned by post, an estimate is provided before conclusion.
7. The Customer may arrange the return independently or ask the Seller to arrange collection. In the latter case, the Seller states the collection cost in advance and, once accepted, may deduct the agreed amount from the refund.
8. The Seller refunds all received payments, including the cost of the least expensive ordinary delivery method offered for that Order, no later than 14 days after receiving the withdrawal statement. If delivery was free, the refunded delivery cost is PLN 0.
9. The Seller may withhold reimbursement until receiving the Product or proof it has been sent back, whichever occurs first, unless the Seller offered collection.
10. Reimbursement uses the same payment method unless the Customer expressly agrees to another cost-free method.
11. The Customer is liable for any diminished value of the Product resulting from use beyond what is necessary to establish its nature, characteristics and functioning.
12. Withdrawal does not apply in the cases listed in Article 38 of the Polish Consumer Rights Act, in particular a non-prefabricated good made to the Consumer’s specification or clearly personalised.
13. Selecting a standard option offered in the Store, including size, façade or detail colour, stairs, lift, ladder or standard equipment, does not by itself exclude withdrawal.
14. The Seller does not accept cash-on-delivery parcels. Sending a Product cash on delivery without prior agreement is not proper performance of the return obligation and does not oblige the Seller to bear collection charges; it does not affect the effectiveness of a timely withdrawal statement.
15. The Customer should protect the Product for transport appropriately to its type and dimensions. Original packaging is not required, but the Customer is responsible for damage resulting from inadequate protection.
§ 12. Personalised Products and Individual Orders
1. The scope of an Individual Order is agreed with the Seller, in particular by e-mail. Before fulfilment starts, the Customer receives the design description, price, lead time, deposit amount, payment schedule and information about the Product’s individual character.
2. The standard deposit is 30% of the price unless the individual offer states otherwise. It is credited towards the price.
3. An Individual Order contract is concluded after the Customer accepts terms sent on a Durable Medium and the Seller receives the required deposit or other agreed payment.
4. Where the contract concerns a non-prefabricated Product made to the Customer’s accepted individual specification or clearly personalised to meet their individual needs, the Consumer has no statutory right of withdrawal. Information about this exclusion is given before conclusion.
5. If the Customer cancels before the Seller has incurred fulfilment costs, the deposit is refunded in full.
6. If the Seller has ordered materials, prepared an individual design or started production, the Seller may settle actually incurred and justified costs from the deposit. The unused part is refunded.
7. Changes requested after design approval may change price and lead time. The Seller begins them after the Customer accepts updated terms.
8. Exclusion of withdrawal does not limit the Customer’s statutory rights where the Product is not in conformity with the Sales Contract.
§ 13. Complaints and Product conformity
1. § 13. Complaints and Product conformity
2. The Seller is liable for lack of conformity existing upon delivery and discovered within two years thereafter, unless a longer usability period has been specified. A lack of conformity disclosed within two years is presumed to have existed at delivery unless proven otherwise or incompatible with the Product’s nature or the lack of conformity.
3. Lack of conformity includes incorrect assembly by the Customer if it resulted from errors or omissions in instructions supplied by the Seller.
4. A complaint may be sent to: contact@happy-mouse.pl or in writing to the Seller’s address. Appendix 2 may be used but is not mandatory.
5. To facilitate handling, it is helpful to provide contact details, Order number, Product identification, date the problem was found, description and requested remedy. Photographs may assist assessment but are not required.
6. If the Product is non-conforming, the Customer may request repair or replacement. The Seller may replace instead of repair, or repair instead of replace, where the remedy chosen is impossible or would involve excessive cost.
7. The Seller may refuse to bring the Product into conformity where repair and replacement are impossible or would involve excessive cost.
8. The Customer may submit a declaration of price reduction or withdrawal in circumstances provided by law, in particular where the Seller refused or failed to bring the Product into conformity, non-conformity persists or is material, or circumstances show conformity will not be achieved within a reasonable time or without excessive inconvenience.
9. The Customer may not withdraw where the lack of conformity is immaterial.
10. The Seller responds within 14 days of receipt; failure to respond has the consequences set out in applicable law.
11. The Seller bears repair, replacement, collection and re-delivery costs. The method of transferring a large Product is agreed case by case to limit inconvenience.
12. The Seller provides no separate commercial guarantee unless expressly stated for a specific Product. Absence of a guarantee does not limit statutory liability.
§ 14. Complaints about Electronic Services
1. Complaints concerning the Account, Order Form, Newsletter or other Electronic Services may be sent to: contact@happy-mouse.pl.
2. Where possible, a complaint should include details identifying the Customer, a description and date of the problem, and the expected solution.
3. The Seller considers an Electronic Service complaint within 14 days of receipt.
4. The Customer may terminate the Account or Newsletter contract at any time with future effect using the Account function, unsubscribe link or e-mail. Account deletion does not remove Order records, invoices or data which must continue to be retained by law or to establish, pursue or defend claims.
5. The Seller may terminate a continuous Electronic Service contract for important reasons, in particular serious breach of these Terms, after prior notice to cease the breach unless immediate action is necessary for security or required by law.
§ 15. Personal data and cookies
1. The Seller is the controller of personal data. Detailed information on purposes, legal bases, recipients, processing periods and data-subject rights is in the Privacy Policy.
2. Data necessary to conclude and perform a Sales Contract is processed on the basis of performance of the contract and legal obligations, not Customer consent.
3. Customer consent is obtained where required by law, in particular for the Newsletter, certain electronic marketing and non-essential cookies and similar technologies.
4. Cookie use and consent management are set out in the Cookie Policy and the privacy-settings panel available in the Store.
§ 16. Provisions for entrepreneurs
1. This section applies to Customers who are neither Consumers nor Entrepreneurs with Consumer rights.
2. The Seller may make fulfilment of an entrepreneur’s Order conditional on prepayment of all or part of the price and may limit available payment methods.
3. In relation to entrepreneur Customers without Consumer rights under the relevant contract, the Seller’s statutory warranty liability is excluded pursuant to Article 558 § 1 of the Polish Civil Code.
4. When the Product is handed over to the entrepreneur, a person indicated by it, or a carrier for delivery to the entrepreneur, benefits and burdens connected with the Product and the risk of accidental loss or damage pass to the entrepreneur unless otherwise individually agreed.
5. The entrepreneur should examine the shipment and Product at the time and in the manner customary for goods of that kind and, where loss, damage or another irregularity is found, promptly notify the Seller and take steps necessary to establish carrier liability.
6. The Seller’s liability to an entrepreneur is limited to actual direct damage and may not exceed the value of the Order concerned. This does not apply to intentional damage, personal injury, or cases where limitation is prohibited by mandatory law.
7. Disputes arising from contracts with entrepreneurs are heard by the court having territorial jurisdiction over the Seller’s place of business, where such jurisdiction agreement is permitted by applicable law.
§ 17. Out-of-court dispute resolution and applicable law
1. If a Consumer complaint does not resolve a dispute, the Seller provides the Consumer, on paper or another Durable Medium, with a statement consenting to or refusing participation in out-of-court consumer dispute resolution.
2. If consent is given, the Seller identifies the entity competent for the dispute and provides information needed to use the procedure. This may in particular be the competent Provincial Inspector of Trade Inspection. The current list of authorised bodies is made available by the President of the Office of Competition and Consumer Protection.
3. A Consumer may obtain free assistance from a municipal or district consumer ombudsman and from information published by the President of the Office of Competition and Consumer Protection.
4. Out-of-court proceedings are generally voluntary and do not exclude the right to pursue claims before a common court.
5. Polish law applies to Sales Contracts. This choice does not deprive a Consumer of protection afforded by mandatory provisions of the law of their habitual residence where those provisions apply.
6. Consumer disputes are resolved by the competent common court under applicable law.
§ 18. Final provisions
1. The Seller may amend these Terms for important reasons, in particular changes in law, Store operation, payment or delivery methods, offer, technology, security requirements or Seller details.
2. An amendment does not affect rights acquired by Customers or Sales Contracts concluded before the amended version takes effect. The version accepted when placing an Order applies to that Order.
3. For changes concerning continuous Electronic Services, the Seller informs the Customer by e-mail at least 14 days before the change takes effect. The Customer may resign from that Electronic Service before that date.
4. The current Terms are made available in the Store in a way that enables downloading, saving and printing. The version applicable to a given Order is supplied to the Customer on a Durable Medium and stored by the Seller. At the Customer’s request, the Seller provides the version applicable to their contract.
5. These Terms were prepared in Polish. A translation may be provided once a full language version of the Store has been launched. This does not limit Consumer protection resulting from mandatory provisions of the law of the Consumer’s habitual residence.
6. Matters not governed herein are subject to applicable law.
7. These Terms take effect on 23 July 2026.
