Personal data Controller<\/h2>\n\n<p>The Controller of personal data is Krzysztof Kami\u0144ski, conducting\nbusiness activity under the business name HM Krzysztof Kami\u0144ski, ul.\nZdrowa 6 lok. Zdrowa 6 lok. U1, 02-747 Warszawa.<\/li>\n<\/ul>\n\n<p>The Controller has not appointed a data protection officer. In all\nmatters concerning personal data, the Controller may be contacted\ndirectly.<\/p>\n\n<h2>\u00a7 2. Scope of collected data<\/h2>\n\n<p>Depending on the manner of using the Store, the Controller may process\nin particular:<\/p>\n\n<ul>\n<li>first name and surname, company name, Tax\nIdentification Number (NIP) and data of the person representing the\ncompany,<\/li>\n<li>billing address and delivery address, country, postal code,\ncity,<\/li>\n<li>e-mail address and telephone number,<\/li>\n<li>customer account data,\nlogin history and Order history,<\/li>\n<li>information about the Order, selected\nvariants, personalization, payment, delivery, return or complaint,<\/li>\n<li>data necessary to issue an invoice or another accounting document,<\/li>\n<li>content of correspondence and information provided in forms or\nmessages,<\/li>\n<li>IP address, device and browser identifiers, server log data\nand information about activity in the Store,<\/li>\n<li>identifiers of cookies\nand similar technologies -- only to the extent resulting from the User's\nconsent settings,<\/li>\n<li>other data voluntarily provided by the data subject.<\/li>\n<\/ul>\n\n<p>The Controller does not request the provision of special categories of\npersonal data, such as information about health, beliefs, origin or\nbiometric data. Such data should not be sent in the content of an Order,\nmessage or complaint.<\/p>\n\n<h2>\u00a7 3. Purposes and legal bases of processing<\/h2>\n\n<p>Personal data may be processed for the following purposes:<\/p>\n\n<ul>\n<li><strong>conclusion and performance of the Sales Agreement,<\/strong>including acceptance of the Order, preparation of the Product, personalization, contact regarding fulfilment, delivery, handling of payments and returns \u2013 Article 6(1)(b) GDPR,<\/li>\n<li><strong>maintaining the Customer account<\/strong> and providing electronic services \u2013 Article 6(1)(b) GDPR,<\/li>\n<li><strong>preparation of an individual quotation or response to an enquiry before conclusion of the Agreement<\/strong> Article 6(1)(b) GDPR or Article 6(1)(f) GDPR,<\/li>\n<li><strong>issuing and storing invoices, accounting documents and fulfilment of tax obligations<\/strong> \u2013 art. 6 ust. 1 lit. c RODO,<\/li>\n<li><strong>handling withdrawals from the Agreement, returns, complaints and ensuring conformity of the Product with the Agreement<\/strong> handling withdrawals from the Agreement, returns, complaints and ensuring conformity of the Product with the Agreement \u2013 Article 6(1)(c) GDPR, and to the extent exceeding the statutory obligation also Article 6(1)(b) or (f) GDPR,<\/li>\n<li><strong>establishment, pursuit or defence of claims, prevention of abuse and ensuring the security of the Store<\/strong> Article 6(1)(f) GDPR; the legitimate interest is the protection of the rights of the Controller, Customers and the security of systems,<\/li>\n<li><strong>conducting correspondence and handling enquiries<\/strong> Article 6(1)(b) or (f) GDPR,<\/li>\n<li><strong>sending the newsletter and marketing information<\/strong> Article 6(1)(a) GDPR and consent required by the provisions concerning electronic communications,<\/li>\n<li><strong>analytics of the use of the Store<\/strong> Article 6(1)(a) GDPR, if consent to cookies or similar technologies is required,<\/li>\n<li><strong>measuring advertising effectiveness, remarketing and advertising personalization<\/strong> Article 6(1)(a) GDPR,<\/li>\n<li><strong>maintaining Happy Mouse profiles on social media and handling user interactions<\/strong> Article 6(1)(f) GDPR; the legitimate interest is communication with recipients and promotion of the brand.<\/li>\n<\/ul>\n\n<p>If the basis for processing is consent, it may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.<\/p>\n\n<h2>\u00a7 4. Mandatory or voluntary provision of data<\/h2>\n\n<p>Providing data marked as required when placing an Order is necessary to conclude and perform the Agreement. Failure to provide such data may make it impossible to accept the Order, deliver it, process payment, issue an accounting document or consider a complaint.<\/p>\n\n<p>Providing data for the purpose of creating an account, subscribing to the newsletter or using optional functions is voluntary. An Order may be placed without creating an account if such an option is available in the Store.<\/p>\n\n<h2>\u00a7 5. Recipients of data<\/h2>\n\n<p>Data may be transferred only to the extent necessary to achieve a specific purpose to the following categories of recipients:<\/p>\n\n<ul>\n<li>hosting, e-mail and IT service providers, in particular LH.pl Sp. z o.o<\/li>\n<li>providers of software and services maintaining the Store, database, backups and security,<\/li>\n<li>payment operators, banks and entities handling refunds, in particular the Paynow operator and entities cooperating with it in connection with the selected payment method,<\/li>\n<li>courier companies, carriers, postal operators and entities handling delivery or collection of the Product,<\/li>\n<li>entities handling invoices and accounting, in particular Fakturownia sp. z o.o. and the Controller\u2019s accounting office,<\/li>\n<li>newsletter and transactional e-mail providers, in particular MailPoet \/ Automattic,<\/li>\n<li>Google Ireland Limited \u2013 in connection with Google Analytics 4, Google Site Kit and other Google services, if they have been activated in accordance with consent settings,<\/li>\n<li>Meta Platforms Ireland Limited \u2013 in connection with Meta Pixel, Conversions API, the product catalogue and Meta advertising services, if they have been activated in accordance with consent settings,<\/li>\n<li>Complianz B.V. \u2013 within the scope related to consent management and cookie documentation, if a given function requires communication with an external service,<\/li>\n<li>entities providing the Controller with legal, debt collection, audit, accounting and advisory services,<\/li>\n<li>public authorities, courts and other authorised institutions, if the obligation to disclose data results from legal provisions.<\/li>\n<\/ul>\n\n<p>Some recipients, in particular payment operators, banks, carriers, Google and Meta, may act as separate data controllers to the extent that they independently determine the purposes and means of processing. Detailed rules of such processing are set out in their own privacy policies.<\/p>\n\n<h2>\u00a7 6. Store, Customer account, Orders and payments<\/h2>\n\n<p>The Store operates on the basis of WordPress and WooCommerce. Data concerning Orders are stored in the Store database on the Controller\u2019s server. The Customer account enables, in particular, access to account data, Order history and saved addresses.<\/p>\n\n<p>Electronic payments are processed by external operators. As a rule, the Controller receives information about the payment status, transaction identifier, selected method and amount. Full payment instrument data, such as the card number, are not stored by the Controller if they are entered directly into the payment operator\u2019s system.<\/p>\n\n<p>Depending on the selected payment method, data may be processed by the Paynow operator, mElements S.A., the Customer\u2019s bank, a payment organisation, a digital wallet provider, an entity financing deferred payment or another operator indicated before payment approval.<\/p>\n\n<h2>\u00a7 7. Invoices and accounting documents<\/h2>\n\n<p>In order to issue and deliver an electronic invoice, Order data may be transferred to the Fakturownia system. This includes, in particular, first name and surname or company name, address, Tax Identification Number (NIP), e-mail address, information about Products, price, payment and date of sale.<\/p>\n\n<p>Accounting documents are stored for the period required by tax and accounting regulations. Deletion of the Customer account does not result in deletion of documents which the Controller is obliged to retain.<\/p>\n\n<h2>\u00a7 8. Newsletter and marketing communication<\/h2>\n\n<p>The newsletter may be handled using MailPoet. For this purpose, primarily the e-mail address is processed, as well as the first name, subscription status, date of granting or withdrawing consent and technical information related to message delivery.<\/p>\n\n<p>Subscription to the newsletter is voluntary. Consent may be withdrawn at any time via the unsubscribe link included in the message or by contacting the Controller. After unsubscribing, the address may be stored on a mailing suppression list solely for the purpose of demonstrating and respecting the objection or withdrawal of consent.<\/p>\n\n<h2>\u00a7 9. Google Analytics 4 and Google Site Kit<\/h2>\n\n<p>After consent to statistics has been given, the Store may use Google Analytics 4 implemented using Google Site Kit. The tool is used to create statistics on the use of the Store, analyse traffic sources, devices, content popularity and purchasing behaviour.<\/p>\n\n<p>In connection with the use of Google Analytics, the following may be processed in particular: IP address, cookie or device identifiers, approximate location, information about the browser and device, pages visited, source of the visit and e-commerce events.<\/p>\n\n<p>Google Analytics is not launched before the required consent has been given. Consent may be changed or withdrawn at any time using the cookie settings available in the Store.<\/p>\n\n<p>More information about data processing by Google can be found in the Google Privacy Policy. <a href=\"https:\/\/policies.google.com\/privacy\" target=\"_blank\" rel=\"noopener\">Polityce prywatno\u015bci Google<\/a>.<\/p>\n\n<h2>\u00a7 10. Meta Pixel, Conversions API and product catalogue<\/h2>\n\n<p>After marketing consent has been given, the Store may use Meta tools, including Meta Pixel, Conversions API and the Meta for WooCommerce product catalogue. These tools are used to measure advertising effectiveness, create audiences, remarketing, analyse purchase events and display advertisements better matched to users\u2019 interests.<\/p>\n\n<p>Depending on the event, information such as e-mail address, telephone number, IP address, cookie identifiers, information about the browser and device, Products viewed, addition to cart, initiation of payment, purchase, Order value and Product identifier may be transferred to Meta or made available in hashed form.<\/p>\n\n<p>Meta marketing tools are not launched before the required consent has been given. Withdrawal of consent results in blocking further sending of marketing events from the browser and \u2013 to the extent controlled by the Store \u2013 server-side events related to these tools.<\/p>\n\n<p>More information can be found in the Meta Privacy Policy. <a href=\"https:\/\/www.facebook.com\/privacy\/policy\/\" target=\"_blank\" rel=\"noopener\">Polityce prywatno\u015bci Meta<\/a>.<\/p>\n\n<h2>\u00a7 11. Cookies and consent management<\/h2>\n\n<p>The Store uses cookies and similar technologies. Essential cookies may be used without additional consent when they are necessary for the operation of the Store, maintaining the cart, security, login, payment handling or remembering privacy choices.<\/p>\n\n<p>Functional, statistical and marketing cookies are used in accordance with the choice made in the consent banner. The Complianz plugin is used to manage consents. Information about the consent choice may be stored together with an anonymous or pseudonymous identifier and technical data necessary to demonstrate the choice.<\/p>\n\n<p>Detailed information about the types of cookies, providers and their duration can be found in the <a href=\"https:\/\/happymouse.eu\/en\/polityka-cookies\/\">Cookie Policy.<\/a>Consents may be changed at any time using the \u201cCookie settings\u201d link available in the Store footer.<\/p>\n\n<h2>\u00a7 12. Social media and external content<\/h2>\n\n<p>The Controller maintains Happy Mouse profiles on Facebook and Instagram. When visiting a profile or interacting with a publication, data are processed in accordance with the rules of the given service. With regard to statistics concerning pages and profiles, the Controller and the relevant Meta entity may act as joint controllers.<\/p>\n\n<p>The Store may contain ordinary links to social media and embedded content, e.g. an Instagram feed. Simply clicking a link results in being redirected to an external service. Embedded content and related external technologies are activated in accordance with the User\u2019s consent settings.<\/p>\n\n<h2>\u00a7 13. Transfer of data outside the European Economic Area<\/h2>\n\n<p>Some service providers, in particular Google, Meta and Automattic, may also process data outside the European Economic Area, including in the United States.<\/p>\n\n<p>In such a case, the transfer of data takes place on the basis of an appropriate mechanism provided for by the GDPR, in particular a European Commission adequacy decision, standard contractual clauses or another legally permissible basis. Details concerning transfers are available in the privacy policies of individual providers.<\/p>\n\n<h2>\u00a7 14. Data retention period<\/h2>\n\n<p>Data are stored for no longer than is necessary for the purpose for which they were collected, taking into account legal obligations and the need to protect claims. In particular:<\/p>\n\n<ul>\n<li>data related to the Agreement and Order \u2013 for the duration of performance of the Agreement and subsequently until the expiry of the applicable limitation period for claims,<\/li>\n<li>accounting and tax documents \u2013 for the period required by the applicable regulations,<\/li>\n<li>customer account data \u2013 until the account is deleted, subject to data that must remain in Order, accounting or complaint documentation,<\/li>\n<li>data from enquiries and correspondence \u2013 for the duration of correspondence and subsequently until they are no longer needed to demonstrate its course or protect claims,<\/li>\n<li>newsletter data \u2013 until consent is withdrawn or mailing ends, and data confirming consent or objection \u2013 for the period necessary to demonstrate compliance of activities with the law,<\/li>\n<li>data concerning complaints and returns \u2013 for the period of their handling and subsequently until the expiry of the period of liability and limitation of claims,<\/li>\n<li>analytical and marketing data \u2013 in accordance with the duration of a given identifier, consent settings and the rules set out in the Cookie Policy.<\/li>\n<\/ul>\n\n<h2>\u00a7 15. Rights of data subjects<\/h2>\n\n<p>Depending on the basis and circumstances of processing, the data subject may have the right to:<\/p>\n\n<ul>\n<li>access the data and receive a copy thereof,<\/li>\n<li>rectify the data,<\/li>\n<li>erase the data,<\/li>\n<li>restrict processing,<\/li>\n<li>data portability,<\/li>\n<li>object to processing based on a legitimate interest,<\/li>\n<li>object to direct marketing,<\/li>\n<li>withdraw consent at any time,<\/li>\n<li>lodge a complaint with the President of the Personal Data Protection Office.<\/li>\n<\/ul>\n\n<p>A request may be sent to <a href=\"mailto:contact@happy-mouse.pl\">contact@happy-mouse.pl<\/a>Before fulfilling the request, the Controller may ask for information necessary to confirm the identity of the person submitting the request.<\/p>\n\n<p>A complaint may be lodged with the President of the Personal Data Protection Office. Information on how to lodge a complaint is available at uodo.gov.pl. <a href=\"https:\/\/uodo.gov.pl\" target=\"_blank\" rel=\"noopener\">https:\/\/uodo.gov.pl<\/a>.<\/p>\n\n<h2>16. Profiling and automated decision-making<\/h2>\n\n<p>In connection with Google and Meta services, advertising profiles or audiences may be created on the basis of activity in the Store, but only after the required consent has been given.<\/p>\n\n<p>The Controller does not make decisions concerning Customers which produce legal effects or similarly significantly affect them solely on the basis of automated processing.<\/p>\n\n<h2>\u00a7 17. Data security<\/h2>\n\n<p>The Controller applies technical and organisational measures appropriate to the nature of the data processed and the risk, in particular an encrypted HTTPS connection, access control to the administration panel, user authentication, backups, software updates, restriction of access to data and security measures for the server and payment systems.<\/p>\n\n<p>However, no method of data transmission or storage guarantees complete security. If a data security breach is suspected, the Controller should be contacted immediately.<\/p>\n\n<h2>\u00a7 18. Children\u2019s data<\/h2>\n\n<p>Happy Mouse Products are intended for children; however, Orders and accounts in the Store are intended for adults with full legal capacity. The Controller does not intend to knowingly collect children\u2019s personal data through the Store.<\/p>\n\n<h2>\u00a7 19. Changes to the Privacy Policy<\/h2>\n\n<p>The Policy may be updated in the event of changes to regulations, the manner of operation of the Store, services used or data recipients. The current version is published on this page together with the date of the last update.<\/p>\n\n<p>The Polish version of the Privacy Policy is the source version.
